我也是為了這次事件才開始看一些法律條文的 (誰沒事看那個 XD)
就小弟的認知, 現在, 要打官司,
如果走傳統正攻路線, 有兩關要過, 就能拿到螢幕:
1. 買賣契約是否成立
一般來說, 網站的價格被視同是廣告, 屬於要約引誘,
而實體陳列, 算是要約, 這些都聽不懂沒關係,
簡單來說就是, 到底你在網路上, 下了訂單, 給了信用卡卡號, 甚至匯了款,
這個過程到底是否構成買賣契約?
常識:就我的常識,我覺得算
法務部網站見解:不算(說實在話法務部網站給的資料都亂七八糟的自我矛盾一堆)
消保單位:算(不然消保單位還忙啥)
判例:我找到的,算(雖然判不賠但不是因為這原因)
魔人:不算(反正魔人說了算..)
這關應該比較好過
2. DELL是否能以民法88條撤回表意,使契約不成立
第 88 條 (錯誤之意思表示)
意思表示之內容有錯誤,或表意人若知其事情即不為意思表示者,表意人
得將其意思表示撤銷之。但以其錯誤或不知事情,非由表意人自己之過失
者為限。
簡單來說就是,如果有人寫錯契約上的東西所以想撤回契約, 是可以的,
前提是寫錯契約上的東西, 不是因為自己的過失
那過失又分blahblah種,這邊實務上一般採取具體輕過失, 那是什麼一樣不用管
簡單的直接以判例來說就是,之前某廠商之所以不用判出貨賠償,是因為
法官認定 "他在三小時內就修正網頁", 有 "盡注意義務而無過失"

那麼重點來了:
判例中是台灣小廠商+非自己平台+1小時內處置+3小時內修復,所以=盡注意義務而無過失;
DELL是世界超級大廠+自己的平台+今年2度出包+超過9.5小時修復....

如果這兩點都能突破, 那我想法官應該會至少依照消保會建議,判賠出貨一台
有什麼疏漏,不足,還請懂法律的前輩指導,感謝
