店家不退訂金 反要求更改規格 - 退費

各位好,
小弟於5/10去店家下訂了一台筆記型電腦,已先預付全額66K(有給預收明細表)。
店家說約2-4週會到,最晚4週會到。
我在6/07打電話過去詢問一下到貨進度,反被告知說我訂的訂單已經無法出貨。
要求我要更改規格,同時我詢問是否能全額退費或者換更低規格
當時他說不能退費,也不會退差價(態度很強硬)
目前收集的資訊有
1.可以透過消保會線上申訴(已申訴)
2.民法249條第三點(適用嗎?)
還有什麼東西是我需要注意的,謝謝各位。
