某餅乾被驗出三聚氰氨宣佈下架
電詢該廠商退貨相關事宜 客服人員答覆"至原購買處退費"
至購買處辦理退費時 因該處販售之餅乾為兩入裝 本人僅餘其中未開封一包
且無發票 但仍保存商品外層兩入裝印有條碼之塑膠包膜(依此可判斷為該商場售出)
處理人員認定由廠商報價之該商品"促銷價" 除以二且無條件捨去之價額
為該商品之退費金額
(因與長期購入之印象中售價有所出入 而生疑惑)
再次電洽該餅乾製造商客服
客服人員稱"若商品仍在手上可派員回收並退費" 與前日答覆迥然不同
請轉接主管 其業務經理稱"因該商品自中元節後作過近月餘促銷"
"尊重各銷售賣點之退貨處理方式 而因通路販售數量價額不定 且未能保證各通路之
處理人員素質合一 致有個別差異"
請教各位
1.雖因購買日期可能超過四個月 以致無保存該筆購買發票 (但已確認商品尚在保存期限內)
該賣場所稱 依照廠商提供之報價(促銷價) 而非賣場之原售價退費是否合理?
(且如今該項商品已全數下架 何來"促銷價"之說?)
2.非因消費者使用問題而回收之商品退費金額是否依各廠商或賣場自行認定?
抑或是有合理明確之相關法規 告知業者應採取相當作為 同時使消費者能據此積極主張
因買方已於無危險意識中承擔該食品風險 循正當管道退貨卻仍被不正計算機制致二次剝削
消費者是否有自保方式或其他洽詢申訴管道?

在乎的不是區區差價 而是廠商的處理態度及其應負之企業責任
