1)本件不適用消費法猶豫期,詳解就不說了,
重點在原PO去家具展買床墊,在實務判決並不認為消費者
無心理準備。
2)英國進口的牌子,在一般消費者經驗,指的應該是標的物
是原裝進口,產地製造地皆是指英國而言,
有人想作相反解釋,那隨便你,你要認為英國進口的牌子
也可以是英國牌子,製造地不重要,那只能說你的消費經
驗有別於一般人。
SONY日本進口電腦,Toshiba日本進口電腦,
跟SONY電腦,跟Toshiba電腦,兩者相同?或兩者不同?
3)原PO能否解約,僅能從床墊是否符合契約標的。
今天的契約標的是六萬,有網友認為要求出示完稅證明是
過份要求?契約標的若是英國原裝進口,完稅證明就是應
付證明,那裏過份?
若不侷限原裝字義,改以英國進口,則是用原產地證明,
如果要以對消費者最有利解釋,當然採英國進口是指原裝
進口,那端視消費者的認知,也是攻擊防禦方法的選擇。
六萬塊標的要完稅證明是找麻煩?那六十萬呢?六百萬呢?
二千萬的法拉利,能不能要求進口商要有完稅證明?是否
要求過當?
如果一九九元不能主張,二千萬的法拉利也不能主張才是。
法律上的權利如果是建立在價金的多寡,這法律還能叫法律
嘛?當然一九九元跟二千萬元的交易都能主張權利,如果
網友的觀念是先入為主認為多少錢可以,多少錢不行,那
麼就是法律觀念錯了,可以反覆思考以此來判斷
4)消費者認為標的物是英國原裝進口,進口商應檢附完稅證明
,無完稅證明,進口商如何證明來源地?
花了六萬塊去買一個組裝的英國進口貨嘛?
車線,織布,獨立筒,都是次級貨,你能接受嘛?
消費者憑什麼不能採有利自己解釋去要求契約標的?

有服務熱忱的態度很好,但是重要的,關鍵的,都不是一個
