案情(?):
這是一筆關於收藏品的交易。
賣方為有商業登記之營利賣家、官方公告代理、實體店,故買家才會走消基會程序。
賣場販售商品賣場之敘述與實體差異很大,此非買方主觀偏好因素,
而是由數字即可判斷的尺寸問題,因此我要求退貨。
賣方不願意負擔退回郵資,說這樣會「虧本」,無法承擔這筆費用,
要求我先寄回貨物,收到後再退款,並要買方取消交易。
買家退貨、先取回本金後,給予負評並就退回運費理論。
(消基會建議買方先取回本金再談),
賣方因此打至我家裡,要求我父母叫我撤下評價及取消交易;
事後又來電給我,強調他非代理非專業,只是賣好玩的玩票性質!
(賣方不承認自己為兔姬代理,僅為代購,
但事後我向官方求證,賣方確實為台灣代理。)
雙方在電話中協議暫時緩談,結果賣方隔天就向露天提出「買家棄標」
(推測是想消除負評紀錄,評價頁因此被撤)。
我被賣方小動作搞到煩不勝煩(不想拖到過年),決定退讓一步
提出三個要求:
1.勿再來電至我的手機或我家中電話,造成本人及家人困擾。
2.退回80元運費至我方帳戶。
3.由「賣方提出取消交易」,我方收到退款後「一定」會答應。
第2、3點希望能在48小時內完成。
賣方退運費→賣方提出取消交易→買方收到退款並答應取消交易→結案。
結果賣方說條件不能接受,星期三前部取消交易就要告我=_=
唉…我實在無心力再跟他耗,
但要我提出取消交易(紀錄會留在我這)實在很悶…
雖然我很想繼續跟他槓下去,但家人的壓力…而且快過年了,不想再弄這件麻煩事阿Q_Q
明天要去找地方政府找消保官?請問有人有經驗可以分享嗎?
