買到4萬壞筆電在第2天退貨但經銷商不賠包膜費,這樣公平嗎? - 退貨

跟經銷商買了約4萬的筆電並花1600包膜後發現筆電是無法正常使用的瑕疵品,
該筆電經查system log後發現購買前3個月間陸續有被使用,
7天內去經銷商換新品時, 包膜就連同壞機被回收,
銷商主張不賠償包膜費, 理由是非店家包膜且沒要求使用者去包膜
我的損失包括
1) 包膜費,
2) 來回多次原廠送檢與經銷商的車費與搬運勞力,
3) 一整天的時間用來在更新設定電腦與釐清問題
4) 3-5天本來有筆電可用來工作的機會成本
請問這樣於理於法公平嗎?
所有損失皆是店家賣壞掉筆電所導致的, 如果今天是我鈔票放筆電上而筆電燒起來呢?
我有哪些伸訴管道?
