商品標題數量與賣場照片數量不同 - 消費者保護

小弟在露天拍賣買了一樣物品
標題是寫五件同款商品一起賣
標價是100元整
但是賣場照片只有兩件的照片
小弟不疑有他就下標了
過不久就收到對方信件如下:
你好,數量是指有圖二中的橘色兩隻喔
其他三隻已經賣出了,沒有改到拍賣標題
但是以圖片所賣的為準,您是要面交還是由記呢?
thx
我還沒有匯款
對方提供兩隻賣100元或是取消此次拍賣的選項
應該不是惡意詐欺 否則就不會立刻提醒我
但是我有沒有辦法以任何法律主張對方必須在我匯款後寄給我五件商品呢?
戴爾的案件是否是用呢?
希望有善心人士能夠給個意見@@
