去消基會法諮的結果 - 消費者保護

今天下午跟公司請假,前往消基會法諮,順便問一下消基會的動向~~
一、消基會目前是由台北分會在處理這件案子,但是還沒決定要不要起動團體訴訟
就不知道了。也許是台北消基會是正在跟呆鵝協商也說不定。
ps:如果協商是按照原來消保會提的結果,我倒是可以接受~~~
因為至少有對戴爾作出應有的懲罰,這樣才不會還有商家來這種奧步~~
二、訂單有效,匯不匯款都沒關係,只是訂購程序上,七日後呆鵝是可取消,因為有列在
訂購的時候上面,所以七日沒匯款過去,呆鵝是可以取消訂單的。
三、團體訴訟的話目前就台北處理,不過,律師也有說,假如台北不提的話,因為是網路
交易方式所以,如果台北分會不提,各分會也可以提,但是會看情況是不是分會要提
出。
四、提存的問題,律師說,不一定就提存,也可以在法官判定的時候請附條款,類似就匯
款後幾日內,就要出貨之類的但書即可,不一定就要搶在前面。
五、呆鵝目前退匯的情況,就表示呆鵝目前表意不出貨,但表意不出貨,並不是訂單無效
六、我也有將呆鵝這件事如果就這樣不了了之的話,會發生的一些事情,告知律師,也仔
細的分析給該律師,就目前呆鵝跟其他事件不同之處,就其性質、行銷方式、與消費
者的角色告訴律師。
七、打團體訴訟的話,有門檻,而且合於條件的法人團體才能提出,例如消基會
八、律師也建議,如果要自己打的話,數量訂太多的,就要排除,不過數量多少律師沒說
